Do member waivers protect me from liability claims?

Partially — but not completely. Ohio courts have upheld gym liability waivers in many cases, but waivers don't protect you from claims of gross negligence, equipment that wasn't properly maintained, or injuries to minors. A waiver reduces your risk — it doesn't eliminate it. General liability and professional liability coverage remain essential regardless of what your membership agreement says.

I'm an independent personal trainer — do I need my own insurance?

Yes. The gym's policy covers the gym — not you or your instruction. As an independent trainer, you carry your own professional liability exposure for every session you conduct. Your own professional liability policy protects you against claims from clients regardless of whose facility you're training in. Many gyms now require independent trainers to carry their own coverage as a condition of using the facility.

A member had a cardiac event during a class — are we covered?

This depends on the circumstances and how the claim is characterized. If the claim involves premises liability — an AED that wasn't maintained, a delay in calling emergency services — GL responds. If the claim involves professional negligence — a class that was too intense for the member's disclosed fitness level, or failure to properly screen a new member — professional liability is involved. Having both coverages is essential for any fitness facility.

My treadmills broke down during peak season — is that covered?

Only with equipment breakdown coverage — which standard property policies specifically exclude. Equipment breakdown coverage pays to repair or replace your cardio and strength equipment when it fails due to mechanical or electrical breakdown. For a gym whose members pay for access to functional equipment, a breakdown event without this coverage means full out-of-pocket repair costs and potential membership cancellations.
